أعلنت وزارة العدل عن عدم وجود ما يمنع قبول ضمانة المرأة فقهيا وقانونية.
وبعث مدير مكتب وزير العدل خطاب الي خديجة الدويحي يفيد فيه قبول ضمان المرأة لدي الأجهزة الشرطية والقانونية والعدلية حسب دراسة إدارة التشريع بوزارة العدل.
شروط الضامن
وأشارت الدراسة إلى شروط الضامن والتي تقتصر على أن يكون كامل الأهلية وان يكون أهل للتبرع لأن الكفالة من عقود التبرعات وان يكون الضمان برضاء الضامن مؤكدة أن المادة 105 من قانون الإجراءات الجنائية لسنة 1991م نصت على شروط الإفراج بالضمان على المقبوض عليه بعد أن يتعهد شخصيا مع ضمانة مالية مقدرة أو بكفالة شخص آخر يلتزم بإحضار المقبوض عليه مع ضمانة مالية مقدرة
وقالت الدراسة أن النائب العام هي الجهة المخولة بإصدار القواعد اللازمة لتنفيذ أحكام القانون وبالتالي لم تصدر أي قواعد أو منشورات بهذا الخصوص تمنع ضمانة المرأة أو تشترط ضمانة الرجال
